1. Agreement to Terms

By accessing or using ThinkFlow (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access or use the App.

These Terms apply to all users of the App, including without limitation users who are browsers, customers, merchants, and contributors of content.

These Terms are provided by ThinkFlow App ("we," "our," or "us").

2. Description of Service

ThinkFlow is a productivity application that helps you:

  • Create and manage tasks, projects, and team assignments
  • Organize work using AI-powered task extraction and prioritization
  • Schedule and manage meetings with team members
  • Track task completion and productivity metrics
  • Sync data across devices when using an account

The App can be used as a guest user with limited features, or with a paid subscription. Subscription plans include Basic ($5.99/month or $49.99/year) and Pro ($9.99/month or $79.99/year) tiers, each with different capabilities.

3. User Accounts

Account Creation

  • You may use ThinkFlow as a guest user without creating an account
  • To sync data across devices, you must create an account
  • You are responsible for maintaining the confidentiality of your account credentials

Account Types

  • Basic Plan: Access to one account type (Business OR Personal)
  • Pro Plan: Access to both Business and Personal account types with switching capability

Account Responsibility

  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

4. Subscription Terms

Subscription Plans

  • Basic Plan: $5.99 per month or $49.99 per year, billed through Apple's App Store
  • Pro Plan: $9.99 per month or $79.99 per year, billed through Apple's App Store
  • All subscriptions are managed through Apple's App Store subscription system
  • Both Basic and Pro are paid subscription plans (there is no free subscription tier)

Billing and Renewal

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • You can manage and cancel subscriptions through your Apple App Store account settings
  • We do not process refunds directly; refund requests must be made through Apple

Price Changes

  • We reserve the right to modify subscription prices
  • Price changes will be communicated in advance
  • Existing subscribers will be notified of price changes before renewal

5. Acceptable Use

You agree not to:

  • Use the App for any illegal purpose or in violation of any laws
  • Transmit any harmful code, viruses, or malicious software
  • Attempt to gain unauthorized access to the App or its systems
  • Reverse engineer, decompile, or disassemble the App
  • Use the App to harass, abuse, or harm others
  • Impersonate any person or entity
  • Collect or store personal data about other users without permission
  • Use automated systems to access the App without authorization

Violation of these terms may result in immediate termination of your account and access to the App.

6. Intellectual Property

Ownership

  • ThinkFlow and all its content, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws
  • The App's design, logos, and branding are our exclusive property

User Content

  • You retain ownership of all tasks, projects, and data you create in the App
  • By using the App, you grant us a license to store, process, and sync your data to provide the service
  • You are responsible for ensuring you have the right to use any content you create or upload

Restrictions

  • You may not copy, modify, distribute, or create derivative works of the App
  • You may not use our trademarks or branding without written permission

7. AI Features

AI-Powered Features

  • ThinkFlow uses artificial intelligence to extract tasks, assign priorities, and provide productivity insights
  • AI processing may occur locally on your device or through secure third-party services

Data Processing

  • Your task content is processed by AI to provide these features
  • We do not use your data to train AI models for other purposes
  • AI processing is subject to the limitations and accuracy of current AI technology

Availability

  • AI features may require an active internet connection
  • Some AI features are only available with a Pro subscription
  • We reserve the right to modify or discontinue AI features at any time

8. Data and Privacy

Data Storage

  • Your data is stored locally on your device
  • With an account, your data is synced to secure cloud storage provided by Supabase
  • All data stored with Supabase is encrypted
  • You can export your data at any time through the App's export feature

Privacy

  • Our collection and use of your information is governed by our Privacy Policy
  • By using the App, you consent to the collection and use of information as described in our Privacy Policy

Data Deletion

  • You can delete your account and all associated data by contacting support
  • We will delete your data within 30 days of account deletion request
  • Data is encrypted during the retention period
  • Some data may be retained as required by law or for legitimate business purposes

9. Service Availability

Availability

  • We strive to maintain high availability but do not guarantee uninterrupted access
  • The App may be unavailable due to maintenance, updates, or technical issues
  • We are not liable for any downtime or service interruptions

Modifications

  • We reserve the right to modify, suspend, or discontinue any part of the App at any time
  • We may add, remove, or modify features without prior notice
  • We will provide reasonable notice for significant changes that affect your use of the App

10. Disclaimers and Limitations

Service "As Is"

  • The App is provided "as is" and "as available" without warranties of any kind
  • We do not guarantee that the App will be error-free or uninterrupted
  • We are not responsible for any loss of data or productivity resulting from App use

Limitation of Liability

  • To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages
  • Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim

No Guarantees

  • We do not guarantee specific productivity outcomes or results
  • AI features are provided for assistance and may not always be accurate

11. Indemnification

You agree to indemnify, defend, and hold harmless ThinkFlow App and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any content you create or upload through the App

12. Termination

Termination by You

  • You may stop using the App at any time
  • You can delete your account through the App or by contacting support
  • Cancelling your subscription does not automatically delete your account or data

Termination by Us

  • We may suspend or terminate your account if you violate these Terms
  • We may terminate the App or any part of it at any time

Effect of Termination

  • Upon termination, your right to use the App will immediately cease
  • You will lose access to your account and synced data
  • Local data on your device will remain unless you delete the App
  • We may delete your account data after a reasonable period following termination

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of the United States.

You agree that any legal action or proceeding arising out of or relating to these Terms or the App shall be brought exclusively in the courts of the United States.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by:

  • Posting the updated Terms in the App
  • Updating the "Last Updated" date
  • Providing notice through the App or via email for significant changes

Your continued use of the App after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the App and may delete your account.
